Divorce and Maintenance: What Every Spouse Must Know

Divorce is not only the legal end of a marriage but also the beginning of new financial and emotional responsibilities. One of the most important aspects of divorce proceedings is maintenance, which ensures that a financially dependent spouse is not left without support after separation.

Maintenance is based on the principle that marriage creates mutual obligations. When a relationship breaks down, the law steps in to protect the weaker or dependent partner. Either spouse can claim maintenance, though in most cases it is sought by the wife. The objective is to help the dependent spouse maintain a standard of living similar to that enjoyed during the marriage.

Courts consider several factors while deciding maintenance—income of both parties, lifestyle during marriage, duration of marriage, age, health, and responsibilities such as child care. Maintenance can be granted as monthly support or as a one-time lump sum alimony.

In India, maintenance can be claimed under various laws such as the Hindu Marriage Act, Section 125 of CrPC (now BNSS provisions), the Domestic Violence Act, and personal laws applicable to different communities. Even a working spouse may claim maintenance if their income is not sufficient to live with dignity.

Failure to pay court-ordered maintenance can lead to serious legal consequences, including recovery proceedings and even imprisonment. Therefore, understanding one’s rights and duties regarding maintenance is essential before initiating or contesting a divorce.

Divorce should not become a tool for financial harassment, nor should maintenance be denied to someone genuinely in need. Proper legal guidance helps both parties reach a fair and respectful settlement, allowing them to move forward with stability and dignity.
